These Terms of Service govern your access to and use of the DXB Property Match platform. By using our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations of the United Arab Emirates.
All software, algorithms, designs, data structures, and business methodologies within this platform are proprietary and protected by intellectual property laws. Unauthorised copying, reverse engineering, or reproduction of any part of this platform is strictly prohibited and may result in legal action.
By accessing or using the DXB Property Match platform ("Platform"), including all associated websites, mobile applications, and services, you agree to be bound by these Terms of Service ("Terms").
If you are using the Platform on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.
If you do not agree to these Terms, you must immediately cease all use of the Platform.
We reserve the right to update these Terms at any time. Material changes will be communicated via email and in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the updated Terms.
Ownership: The Platform, including but not limited to its source code, object code, software architecture, algorithms, artificial intelligence models, machine learning pipelines, user interface designs, visual elements, graphics, icons, logos, trademarks, trade dress, domain names, text, documentation, databases, data structures, and all related intellectual property, are the exclusive property of DXB Property Match and its licensors.
Copyright: All content on the Platform is protected by international copyright laws, the UAE Federal Law No. 38 of 2021 on Copyright and Neighbouring Rights, and applicable treaties. Unauthorised reproduction, distribution, or modification is strictly prohibited.
Trademarks: "DXB Property Match", our logo, and all related product and service names, slogans, and designs are trademarks of DXB Property Match. You may not use any trademark without prior written consent.
Trade Secrets: The Platform's proprietary algorithms, AI matching technology, lead scoring systems, CRM workflows, analytics engines, and business methodologies constitute trade secrets. Any attempt to reverse-engineer, decompile, disassemble, or derive the source code or underlying ideas of the Platform is strictly prohibited.
No Licence Granted: Nothing in these Terms grants you any right, title, or interest in the Platform's intellectual property beyond the limited right to use the Platform as a subscriber in accordance with these Terms.
You agree NOT to, directly or indirectly:
• Copy, reproduce, duplicate, download, scrape, crawl, or extract any part of the Platform's content, code, design, or data
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code, algorithms, or architecture of the Platform
• Create derivative works, adaptations, or modifications based on any part of the Platform
• Use automated tools (bots, scrapers, spiders) to access, monitor, or copy any portion of the Platform
• Remove, alter, or obscure any copyright notices, trademark notices, or other proprietary rights notices
• Circumvent, disable, or interfere with any security features, access controls, or copy-protection mechanisms
• Sublicense, resell, lease, rent, or otherwise commercially exploit the Platform or any content therein without express written authorisation
• Use the Platform to develop, train, or improve any competing product or service, whether directly or indirectly
• Share, disclose, or transfer your account credentials to any unauthorised third party
• Use the Platform in any manner that could damage, disable, overburden, or impair our servers or networks
Confidential Information: All non-public information about the Platform — including its technology, architecture, algorithms, pricing models, business strategies, customer data, and internal documentation — is considered Confidential Information.
Obligations: You agree to maintain the confidentiality of all Confidential Information, use it solely for the purpose of using the Platform as intended, and not disclose it to any third party without prior written consent.
Survival: Confidentiality obligations survive the termination of your account and these Terms for a period of five (5) years.
Your Content: You retain ownership of content you create or upload to the Platform, including property listings, photos, descriptions, proposals, and client data.
Licence to Us: By uploading content, you grant DXB Property Match a non-exclusive, worldwide, royalty-free licence to use, store, display, and process your content solely for the purpose of operating and improving the Platform.
Responsibility: You are solely responsible for ensuring your content does not infringe any third-party intellectual property rights, and that all property listings comply with UAE RERA regulations.
Removal: You may remove your content at any time. Upon removal, we will delete it from active systems within 30 days, though it may persist in backups for up to 90 days.
Plans: Access to certain features requires a paid subscription. Plan details, pricing, and feature inclusions are described on our Pricing page.
Billing: Subscriptions are billed in advance on a monthly or annual basis. Payment is processed securely through Stripe.
Free Trial: New broker accounts receive a 6-month free trial. No credit card is required during the trial period.
Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period. No refunds are provided for partial periods.
Price Changes: We reserve the right to change subscription pricing with at least 30 days' notice. Existing subscribers with locked pricing (Early Adopter plan) are exempt from increases for the lifetime of their continuous subscription.
As-Is Basis: The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
No Property Guarantees: We do not guarantee the accuracy of property listings, valuations, market data, or AI-generated recommendations. All property decisions should be independently verified.
Liability Cap: To the maximum extent permitted by applicable law, DXB Property Match's total liability arising from or related to these Terms or your use of the Platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
Exclusions: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.
You agree to indemnify, defend, and hold harmless DXB Property Match, its officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
• Your use or misuse of the Platform
• Your violation of these Terms
• Your infringement of any third-party intellectual property or other rights
• Your violation of any applicable law or regulation
• Any content you submit or transmit through the Platform
Injunctive Relief: You acknowledge that any unauthorised use, copying, or disclosure of the Platform's intellectual property would cause irreparable harm to DXB Property Match for which monetary damages would be inadequate. Accordingly, we shall be entitled to seek injunctive or other equitable relief without the necessity of proving actual damages or posting a bond.
Account Suspension: We reserve the right to immediately suspend or terminate your account and access if we reasonably believe you have violated these Terms, without prior notice or liability.
Legal Action: We reserve the right to pursue all available legal remedies, including damages and legal fees, against any party that violates these Terms.
Governing Law: These Terms are governed by and construed in accordance with the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates.
Jurisdiction: Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of the Dubai International Financial Centre (DIFC) or, at our sole discretion, the courts of Dubai.
Arbitration: For disputes exceeding AED 100,000, either party may elect to resolve the dispute through binding arbitration administered by the Dubai International Arbitration Centre (DIAC) in accordance with its rules.
Waiver of Class Action: To the fullest extent permitted by law, you agree to resolve disputes on an individual basis and waive any right to participate in a class, collective, or representative action.
Entire Agreement: These Terms, together with the Privacy Policy and any subscription agreement, constitute the entire agreement between you and DXB Property Match.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
No Waiver: Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
Force Majeure: Neither party shall be liable for any failure to perform due to circumstances beyond reasonable control, including natural disasters, war, government actions, or internet disruptions.
